LICENSE AGREEMENT - UPDATED JULY 13, 2016
You are purchasing an individual LAPWARE DECK or multi-user license (such as through or under the authority of a school) and you agree that access to the LAPWARE program will be used by only you. You agree not to distribute your login name and password to anyone else. LAPWARE has the capability of listing login IP addresses with locations, user names and login names. If you are found to have multiple logins at the same time on two different computers, you accept that your license will be deactivated with no notice. No refund will be provided. Also, there will be no recourse to get your LAPWARE license re-established because you authorize the program administrator's permission to delete all your files associated with your original license. A purchase of a new license, paying the initial cost and set-up fees to use LAPWARE, will be required.
For ALL purchases by individuals or schools (if allowed) via credit cards, note that your full credit card number is NEVER recorded by LAPWARE, LLC and all transactions are performed through PCI DSS Industry Compliant companies. LAPWARE, LLC does receive an invoice copy for our records of all purcahses from Authorize.Net which does contain ONLY the last four digits of your credit card number. This is done so that, if needed, we can communicate with users if they have any problems with our software. NOTHING is mailed, shipped or downloaded to your computer for the program. LAPWARE, LLC is totally an Internet based program requiring you to login to the proper site for the software you purchased using your login name and password you created upon making the purchase. For DECK, the URL is www.Lapware.org and for ENGINE, the URL is www.LapwareEngine.org. PLEASE use the correct URL when accessing your chosen program that you purchased.
However, with your individual license, or license purchased under the authority of a licensed school, you are authorized to be able to login to LAPWARE from any computer in the world
If you wish a refund you should contact RICHARD PLANT directly at either firstname.lastname@example.org or email@example.com. Not doing so and requesting a CHARGE BACK through your bank or credit card service will COST YOU a fee of $25. You agree upon purchasing LAPWARE to pay this fee under ALL CONDITIONS - NO EXCUSES or LIMITATIONS, if you first DO NOT contact Richard Plant for a refund for justifiable reasons. Justifiable reasons presented within the FIRST FEW DAYS of your purchase should be presented and that will determine whether your refund will be provided. ANYONE purchasing a LAPWARE renewal for a second month WILL NEVER be approved for a chargeback refund. After the first month's usage, you should know what you have purchased and to now request a refund or charge back is NOT justifiable. Purchasing DECK when you wanted ENGINE or vice versa is a justifable reason for a refund but ONLY within the first few days of purcahse, based upon limited logins and usage of the software and by first contacting Richard Plant to receive your full refund. Taking the approach of FIRST going through your Credit Card or Bank for the refund, if it is agreed to be paid by LAPWARE you will be charged a $25 fee for such action and this will be deducted from the overall cost you paid. A copy of this LICENSE AGREEMENT will be provided to your bank as proof of your willingness to pay the $25 fee. You hereby agree to pay this $25 cost if you take such actions. So please contact Richard Plant if you have any concerns about using LAPWARE.
Your initial purchase of your LAPWARE license is valid for only one year BUT is sold on a MONTHLY BASIS (30 days of usage). LAPWARE, as stated above, does not record any credit card information. Monthly purchases are solely based upon you and when you want to renew your next 30 days of access based upon your schedule of work, vacation or your time to study. LAPWARE does not automatically bill your credit card monthly! You must provide your credit card for each purchase of 30 days of usage. We allow students/mariners to skip one or more months based upon the fact that they are on vacation, at sea or just not ready to study. When ready, simply login to LAPWARE and, if your last 30 days of usage has expired, you will be asked whether or not you wish to purchase your next 30 days. We try to make this as beneficial to users as is possible. If your last login exceeds more than 12 months your files are automatically deleted.
You agree that after twelve (12) months, from your LAST date of purchase, LAPWARE program administrators are authorized to permanently delete all files, tests, login name and password associated with your original license! Upon completion of your study and passing your exam you can notify the LAPWARE administrators and we will delete all of your files and records for you.
The only way to maintain your license beyond the twelve (12) month period is to notify the LAPWARE administrators who will then charge an additional fee of $200 for continued usage of the program allowing you to maintain all files, tests, etc. Therefore, anyone renewing their monthly license, and having used LAPWARE for more than one year, should immediately contact the program administrators via email.
As a reminder, upon purchasing LAPWARE, please go to the DOWNLOAD menu option, in the brown bar across the top of your screen, and download, print or view files that tell you how to use and study for your license exam using LAPWARE. Also, since you only know when you will be sitting for your license exam, please try to schedule your purchase(s) of LAPWARE, sold ONLY on a 30 day basis, so as to cover the period when you will be sitting for your license so that access to the program will be available for review/study in the evenings PRIOR to taking your exams. LAPWARE, under all conditions, does NOT prorate the purchase of the software on a daily or weekly basis. After all, your successful completion of you passing your exam, and either acquiring your first license or your raise in grade, opens up the door for you to earn potentially additional thousands, if not tens of thousands, of dollars per year. It is not justifiable to request a prorated payback based upon your decision as to when you purchased LAPWARE DECK. Thank you.
